KIELTYKA GLADKOWSKI PARTICIPATED IN INVESTMENT OUTLOOK IN THE CRYPTO MARKETS WORKSHOP

On 28 February 2024 KIELTYKA GLADKOWSKI KG LEGAL participated in the workshop on Investments outlook in the crypto markets. The workshop was devoted to practical aspects of investments in crypto entities, fintech, crypto market perspectives and risks.

Investments and fundraising strategies in crypto are highly unique. The panel thus aimed to address the complexities and evolving nature of this market. The speakers were Marc de Kloe of Theta Capital, an LP to numerous major crypto VC funds and Matt Walsh, an investor whose firm manages around $240 million.

The regulatory framework is recently changing in Europe in relation to crypto. The European Union’s MiCA entered into force in June 2023. It establishes a regulatory framework for crypto assets not covered by existing financial services legislation on the EU market. It aims to:

– provide a sound legal framework;

– support innovation and promote fair competition; and 

– establish consumer and investor protection to ensure market integrity.

In Poland, the government is working on the Act on Crypto-Assets, the draft of which has just been submitted for consultation and review. It will prohibit offering virtual assets – also other than tokens linked to currencies or expressed in e-money – without permission. The market will be supervised by the Polish Financial Supervision Authority, which will be able to punish entities or people who break the regulations when trading in cryptocurrencies. And punish them severely, because the amounts for illegal conduct will amount to tens of millions of zlotys. Token issuers and cryptocurrency service providers will also be obliged to provide the Polish Financial Supervision Authority with information about their activities.

These regulations may influence the crypto investment risks and evaluation.
